DATA PROTECTION

In the following we want to familiarize you with our data protection policy. It applies to our web page, but not to the pages of other providers which you can access via links.

1. Principles

We will treat all the information which you supply on our website strictly confidentially. It will only be used by Holy AG for internal purposes. It is our policy to put in place safety measures that protect your data as efficiently as possible. All our data processing operations (such as collecting, processing and transferring) comply with the statutory requirements.

2. Browser protected data collecting and processing

Like any other website, our server collects and stores automatically and temporarily the following information in the server log files. This information is transferred by the browser as far as you did not deactivate them in your browser:

- IP address of the inquiring computer

- data inquiry of the client

- http response code

- the website from which you visit our homepage (referrer URL)

- time of the server inquiry

- type and version of browser

- used operating system of the inquiring computer

A personal analysis of this information is not possible for us. There will be no merging with other data sources. The information will be used to improve the content of our website.

3. Google Analytics

Our website uses Google Analytics, a web analysis service provided by Google Inc. ("Google"). Google Analytics uses "cookies" which are text files which are stored on your computer and which allow your use of the website to be analyzed. As a rule, the information about your use of this website which is generated by the cookie is sent to a Google server in the USA and stored there. However, with the activation of IP anonymisation on this website, Google truncates your IP address within European Union member states and in the states which have signed the European Economic Area treaty. The full IP address is only sent to a Google server in the USA and truncated there under exceptional circumstances. Google is commissioned by the operators of this website to use this information to analyze your use of the website, to compile reports on website activity and to provide them with other services in relation to the website and internet use. The IP address sent by your browser for the purposes of Google Analytics is not amalgamated with other Google data. You can use a setting on your browser software to prevent cookies being saved; however, we must advise you that this might mean that not all the functions on this website can then be used. You can also download and install the browser plug-in from the link below to stop data generated by the cookie and related to your use of the website (including your IP-address) being recorded and processed by Google. Please use the following link: (https://tools.google.com/dlpage/gaoptout?hl=de).

4. Integration of Facebook plug-ins

We use "social plug-ins" (such as the Like button) from the facebook.com network. These plug-ins are offered and operated by Facebook Ireland Ltd. and clearly marked with the Facebook logo. When you display a fashionandmusic.de page with this plug-in, your browser creates a link to the Facebook servers. The content of the plug-in is sent directly from Facebook to your browser and displayed in fashionandmusic.de environment. We do not have any control over the content of the plug-in. It might be that the data is processed in the US.

It might be possible for Facebook to track your visit to outletcity.com pages and assign them to a Facebook account if you are registered with Facebook or have previously visited a Facebook page or a page with Facebook content. If you use plug-ins actively (such as pressing the Like button), information is also sent straight from your browser to Facebook. We do not have any control over this.

If you are not a Facebook user and visit our pages with the Facebook Like button, Facebook receives certain data about the visit, including the date, time, URL and browser type. According to Facebook, if you visit our pages with an IP address which Facebook assigns to Germany, your IP address is not saved according to Facebook.

If you have ever visited the Facebook website, it will have placed a Facebook "data cookie" on your computer. The content of this data cookie is sent when you visit our pages. Facebook assures us that this cookie does not have a tracking function, but is intended to prevent non-members inflicting damage, primarily in the form of detecting suspicious activities such as failed login attempts and repeated creation of spam accounts.

If you are a registered Facebook user, Facebook receives the same information as described for non-Facebook-users. If you interact with the social plug-in (such as clicking on the Like button) Facebook will store your IP address in accordance with your data protection agreement with Facebook as well as linking to your Facebook profile.

Please see the Facebook data protection information for more details on the type, purpose and scope of your data and how Facebook processes and uses it. You will also find out more about your rights in these matters and the settings you can use to protect your privacy.

In order to prevent Facebook collecting information about you during your visit to our website, and to counter the collection and storage of data by Facebook, you can log out of Facebook when you start your visit to our pages and at the same time, delete any Facebook cookies that might be present on your browser. To maintain this situation, do not access any more Facebook pages and do not interact with Facebook elements on other web pages.

5. Cookies

Cookies are small text files which are stored on your computer. Most cookies are deleted from your computer after your browser session ends. Other cookies (permanent cookies) remain on your computer and allow us to recognise your computer on your next visit. Our web server, Google (which can be recognised from the cookie name beginning with_utm) and Facebook store these cookies on your computer. See sections 2 and 3 above for a more detailed explanation.

Cookies can be deleted with the browser software. You can also deactivate the option to store cookies or set your browser to notify as soon as cookies are being sent. Unfortunately it is not possible to use our website without cookies.

6. Voluntary provision of data on our site

a) General information

If you register for one of our personalized services, we (will) ask for your name and other personal data. You are free to decide whether you insert these data or not. When you use the contact form, the registration form for our online shop or the press form, the information listed and personal data is sent to us. The information is only used for purposes specified on the form in question or purposes which can easily be determined from the situation, for example to answer your query on the contact form or to provide information about our online shop.

b) Email newsletter

If you want to subscribe to our newsletter, we need your email address and you have the possibility to voluntarily give your name. These data are exclusively used to communicate with you within the context of our newsletter service. By subscribing to the newsletter you agree that we save the aforementioned data for newsletter mailing. The data is not used for further purposes. You can revoke your permission at any time with future effect. You can revoke by clicking on the deregistration link included in each email newsletter.

Immediately after registration for the e-mail newsletter a check is carried out as to whether the recipient of the e-mail genuinely wishes to receive information on the e-mail address given. The recipient must click on a confirmation link in the e-mail which contains reference information to differentiate it from other confirmation links and which is therefore related to a particular person. The reference information is therefore stored with your personal data and serves to determine which newsletter registration is being confirmed.

If we then send you e-mail newsletters on the basis of the data provided, these newsletters contain elements which respond to links in the newsletter being read or confirmed and which are linked to an individual technical identifier. This information is used for an anonymised analysis of all the feedback acquired from the use of the newsletter in the form of statistically collected data. This improves the newsletter service.

7. Information, cancellation, correction and deletion

The Federal Data Protection Act stipulates that you have the right to obtain information at no cost about your saved data and the right to have it corrected, blocked or deleted where relevant.

If you want information about your personal about your personal data or its correction or deletion or have any more questions about the way we use the personal data provided to us, please contact us on the contact details mentioned below.

You can object the use, processing and transfer of your personal data at any time. In the sections below we have described some technical options for objection, otherwise you can object by informing us. If you have given us permission regarding this information on data protection you can revoke your permission at any time with future effect.

For information on the sections mentioned above, you are welcome to informally contact Holy AG, Friedrich-Herrmann-Str. 6, 72555 Metzingen, e-mail: info@fashionandmusic.de.

Developments on our website or the implementation of new technology might make it necessary to change this data protection declaration. We reserve the right to change the data protection declaration with lasting effect at any time. We recommend that you re-read the valid data protection declaration from time to time.
